Jiminy's Journal Judge James A. Doerty, Superior Court, State of Washington, has assumed the powers and responsibilities reserved for the legislature in addition to those granted to him as a judge. He has redefined legal interpretation and construction by merging them. In a similar way he has merged ethics and morals apparently for political expediency. Consequently, he functions more as an out-of-control oligarch than a judge. By that, he denies due process of law on a variety of nebulous grounds. The Constitution of the United States, an instrument of government and supreme law, prescribes the nature, functions, and limits of government. It incorporates amendments that control a system of fundamental laws and principles that have embodied rights and marked fair legal process since 1789. Yet, Doerty has consistently denied due process of law by abrogating constitutional rights. In particular, he has denied the right to: timely notice; prepare a defense; confront accusers; cross-examine witnesses; legal counsel; and, impartial and unbiased hearings. Civil rules do not allow arbitrary or general denials (denying all allegations in a complaint). This applies especially when the complainant declares a readiness to verify the allegations under an oath. Civil Rule 8 permits general denial only when the judge intends in good faith to controvert all the formal assertions of fact. Doerty does not controvert all the averments (declarations and assertions) in the complaints as the law requires. Instead, he arbitrarily rejects or accepts them to suit his own predisposition. Doerty follows a procrastination principle that denies or postpones due process of law. He uses kill-the-messenger techniques that delay justice. He abuses the law meant to rectify unlawful practices and indulges in the same patterns and practice of unethical behavior that the law proscribes. The public failed abysmally in its attempt to establish an honest judiciary when it elected The Honorable James (Jiminy) A. Doerty. Messages Judge James (Jiminy) A. Doerty deleted information from his web site when the going got rough. Admire him for censoring himself under his recent finding that abridged the First Amendment to the US Constitution. However, he did not jail himself for publishing the censored material as he does to his victims. Perhaps, he could not bear the thought of 111 days as a jail wife! Doerty has now removed his guest book. A majority of those messages now appear on this page. Deleted messages include anonymous messages containing irrelevant material and messages subject to censorship by Doerty's court order not to publish the names of Council House directors, staff, and residents, now pending appeal. I am disappointed, however, to hear that you've released Trummel, and will not further punish him for his foolish attempt to assert First Amendment protections. Please do the right thing - lock him up now! This may bring political pressure to bear, but should he refuse to remove himself from public discourse, you'll have any opportunity to do the right thing, and even the loudest dog can't interfere. But these dogs do bring pressure, the very reason for which they should be prohibited from public discourse, and they must be dealt with appropriately. Following the spirit of Freedom of Press, you should remove their comments from your web sites, and prohibit future discourse by unqualified dogs. Their whining and howling is offensive, and interferes in our system of justice, so your prohibition should also consider the possibility of detention. Should they refuse to be quiet, then public funds could be utilized for the creation of education and detainment camps. This may, of course, bring even greater howling, so I will defer to your judgement. But whatever you do, do not allow these ignorant and pathetic dogs to further intrude on the streets!
