Unlawful Entry. Staff has no right to enter any apartment anytime without prior written permission. They may not determine reasonable cause that an emergency exists then enter. They must first call the police or emergency medical crews and have them present before entering. HUD regulations do not require residents to use "I'm OK" cards and an unturned card does not give staff reasonable cause to enter an apartment without prior permission. Those people who do not want unlawful and unwarranted intrusions upon their privacy should give written notice that they will not use the cards. City of Seattle provides first-class emergency services by dialing 911. Residents probably insure their safety and privacy better by using them. HUD regulations do not prevent residents voluntarily using any program if they wish. Frivolous Harassment Claims. Judge Maureen A. Howard, Seattle District Court, denied an antiharassment order for lack of proof of severe emotional stress that Virginia D. Lambert (69) brought against another resident Leon L. Harris (70). Howard said that broadcast statements may offend many but do not cause emotional stress to individuals - harassment describes what people do not what they say publicly. The case related to another in a series of constructive eviction attempts by administrator Stephen A. Mitchell (37). He has developed the habit of using frivolous antiharassment orders and police action to harass and intimidate senior citizen residents. This particular incident took place after a monthly Coffee with Steve meeting (15 Aug 01). Judge Howard had a no-nonsense grasp of the antiharassment statute frequently abused by landlords. Resident Abuse. This ranges from simple denial of ice cream for "rudely" reading a newspaper at a social function to strapping sick residents to gurneys and incarcerating them. Stephen A. Mitchell (37) uses unsubstantiated claims of mental health problems to persuade police to make arrests. He then publicly describes those incidents to intimidate other residents into submitting to his ideological dictates. Moreover, he coerces residents (some quite gullible) to write apologetic letters for perceived rudeness or to make statements under duress. Mitchell places those letters on "unofficial" personal files and later uses them as confessions to support eviction threats and court proceedings against residents he does not like. Daily rule-bending and disingenuous response to questions and complaints leaves residents confused and fearful. An unqualified staff continues to call relatives to bring pressure on residents. Gestapo Tactics. Stephen A. Mitchell (37), Administrator, recently (26 Oct 01) sued a resident and had him unlawfully held in contempt of court for legitimate newsgathering. He called it "surveillance". Ironically, Mitchell maintains a pseudo law-enforcement identification system for gestapo-like surveillance and identification of residents. That book contains mug shots of all Council House residents including the resident that Doerty fined $100/day. Keeping and allowing access to that information violates federal privacy regulations and could result in a fine of up to $5,000 for each photograph. Residents could additionally sue for damages either individually or as a class action. Several residents complained to Audrey F. Dunbar (32) about the book. She then concealed it but still maintains it. Resident sources have reported that she included photographs taken at social gatherings without residents' permission "for security purposes" and did not obtain signed releases before she used them. Sperling Shlock. Associate Rabbi Scott Sperling, Temple De Hirsch Sinai, writes: "I take great pride in the fact that I read, on a regular basis, a host of publications that hold opinions and attitudes radically different than [sic] mine. I have always believed that doing so is the mark of an educated and open-minded individual." This pomposity identifies people who claim "education" and "open-mindedness" then use politically correct strategies to cover up indifference to abuse and neglect. They focus on genre not issues then attack the writer. They use kill-the-messenger techniques and pander to established oligarchies. They twist meaning to weasel out of a responsibility to those whom they serve. With all his self-proclaimed "education", Sperling does not know the difference between ad hominem and iconoclasm: invective without logic or reason and invective that has a definite purpose grounded in logic and reason. Judicious Lying. Stephen A. Mitchell (37) should pay attention to the old Yiddish maxim: Ah a nar shveight, vaist men nisht tsu er iz a nar tsu a chochem [Insecurity, commonly regarded as a weakness in normal people, is the basic tool of the actor's trade]. Mitchell neglects to understand that people love actors for their unoriginality in sticking to scripts. He should have understudied himself to discover his weaknesses before accepting an administrative job. Mitchell has reached his thespian pinnacle by lying to a superior court judge. Those lies (perjury) will probably cause judicial misconduct charges against that judge. They will certainly cause bar association subornation (induced perjury) complaints against his attorney Maureen L. Mitchell (graduated from UW and admitted to WSBA 2000). Violent Confrontation. Michael Johnson tried to prevent delivery of the last edition of Disconnected Abstracts by physical confrontation. This resulted in a visit by police who insured safe delivery of the remaining copies. Johnson previously confronted other residents when he visited the building as an overnight guest. Audrey F. Dunbar and Mark T. Mullen, reportedly fearful of pressure from the homosexual community, then admitted him under the guise of "care-giver". HUD does not allow live-in care-givers in independent living facilities except under very strict rules. Johnson, and another care-giver, Jean Azemove, allegedly do not meet those requirements.The First Amendment to the US Constitution and Seattle landlord and tenant laws guarantee all residents the freedom to write and to read also to speak and to listen in any way that they choose. Using thugs to silence them violates state law and seriously affects individual rights guaranteed by federal law. Nmesis [049]
Pygmies or Hogmies? People who do not identify with pygmies may consider themselves normal although small in physical stature, however, hogmies have different characteristics. Indigenous to Council House, the "hogmy" (Porcus leilavorus) resembles a pig with wings and has an extraordinary appetite.It cannot converse intelligently and continuously cackles "crackpot" to anyone that it cannot understand. Although hogmies have similar intellectual deficiencies to pygmies, they rank as an inferior species because of their physical bulk. Some people compare them to obese administrators whom they resemble in greed and stupidity. However, others show disdain and favor turkeys for religious reasons. Hogmy choruses draw tears from vast worldwide audiences at a single time: tears of relief and thanks for having larger brains and smaller butts. HUD Inspection. Previously, to stop a clockwork Mitchell all one had to do was remove the key from his back and return it to Mullen. Now that HUD has computerized the inspection procedure the problem has become more serious. HUD postponed the last building inspection because of a computer glitch that would not allow Mitchell to accompany the inspector to randomly selected apartments. To stop Mitchell's violent rampage one must now, instead of removing the key from a clockwork mechanism, arrange for an electrical surge to silence him. However, in Washington state he will probably end his life enjoying Club Fed for his misappropriation of government funds and resident abuse. Nmesis [068]
Barbershop Fifteen. Council House directors continue to sing in barbershop style. They harmonize like politically correct song birds then decide to do nothing. Then, conducted by their attorney, they produce incredibly dissonant music. This disharmony results in qualitative control by those making judgment. Moreover, it supports a cultic instinct toward conformity that eliminates any inconvenient nonconformity (also honest dissent). The conformity destroys any vestige of individuality. The exclusivity forces everyone to become like someone else. It enables the administrator to deny freedom of expression to dissenters and allows him to harass nonconformists. It also outlaws any behavior that he finds "inappropriate". The war cries "censor it" and "politically correct" then define synonymously. Nmesis [079]
Apologism and Indifference. Senior citizens remember while later generations choose to forget then perpetuate the inequities of the past. Justice makes democracy possible, however, the inclination to injustice makes democracy necessary. "In Germany they came first for the Communists, and I didn't speak up because I wasn't a Communist. Then they came for the Jews, and I didn't speak up because I wasn't a Jew. Then they came for the trade unionists, and I didn't speak up because I wasn't a trade unionist. Then they came for the Catholics, and I didn't speak up because I was a Protestant. Then they came for me, and by that time no one was left to speak up." Spiritual Guidance. Council House residents have the good fortune to have the in-house "Reverend" Oran E. C--p-r, Church of God for the Eternally Illiterate. He will probably make himself available to counsel people who wish to prepare themselves to join others who have left for a warmer climate when not busy circulating petitions derogating other residents. Shoeshine Anyone? Two street people emerged from an apartment on the eighth floor at 07:40 one morning - a bag lady and a shoeshine man both aged about 35. The woman had her personal belongings with her and the unshaven man had a roughly made shoeshine box constructed from vegetable or fruit box wood. He listened to a walkman. Both people appeared disheveled and dirty. The man held a huge jelly sandwich that he ate in the elevator. They had both obviously crashed for the night. The man offered Nmesis a shoeshine which he declined. They did not check out then separated and went different ways when about 50 yards up 17th Avenue toward Madison Avenue. So much for the much vaunted building security. Council House moves more toward a street oriented culture each day with its $50,000/year administrator allegedly busking (street-singing) for money at Bumpershoot and an in-house shoeshine man. Bulletin Board Censorship. Gilda Kabbani posted a statement made by Eleanor Roosevelt before the United Nations. Audrey F. Dunbar removed it. If one reads the piece then considers Dunbar's supremacist leanings one understands why she censored it. Roosevelt said: "Where, after all, do universal human rights begin? In small places, close to home - so close and so small that they cannot be seen on any map of the world. Yet they are the world of the individual person: the neighborhood he lives in; the school or college he attends; the factory, farm or office where he works. Such are the places where every man, woman and child seeks equal justice, equal opportunity, equal dignity without discrimination. Unless these rights have meaning there, they have little meaning anywhere. Without concerted citizen action to uphold them close to home, we shall look in vain for progress in the larger world." (This act of censorship now forms part of the testimony in the Washington Supreme Court appeal to restore constitutional freedom of speech and other constitutional rights guaranteed by Congress to Council House residents.) Affair. The fair will not now take place for lack of reduced fare permits. Instead, "college-educated" Audrey F. Dunbar will attend remedial courses in English language at a secret location (probably on a cruise). The directors will pay her fare for the outward journey only. Sub-literacy apparently caused disruption at previous fairs. Moreover, lack of crowd control at a recent pseudo art fair, attended by a director for propaganda purposes, decided the issue. Last year, the fair became known for drunkenness causing fights in which some residents lost limbs. A police officer received multiple injures caused by rampaging gray panthers. Seattle Weekly reported that only Council House residents fight each other for amusement. The unfair behavior has caused outrage over the years and pressure grew for the abolishment of the fair and an increase in bus fares.
