Abuse - Physical and Psychological

This letter to Richard R. Beresford, Beresford, Booth, Demaray & Tingstad, Inc., PS, Seattle, Washington, typifies many letters sent to him to draw his attention to the violence and misappropriation of funds at Council House. All those letters related to problems at Council House, Seattle, a government financially-assisted senior citizen residence and its board of directors.

The letter gave Beresford an opportunity to respond to exposé about behavior by Felippe Jacques and to inform his clients. It mentioned that “the persecution by Stephen M. and his staff does not relate to race or religion”. That statement does not now ring true. The discrimination had not fully manifested at the time of writing. Extensive racial and religious discrimination surfaced later.

Each of the directors also received a copy of the letter. Neither Beresford nor the directors responded. On other matters, he begged the question and behaved in an infantile manner. He continued to cover up for his clients until they appointed a different law firm connected with Herzl-Ner Tamid Conservative Congregation to act for them.

Felippe Jacques, the subject of that letter still receives special privileges at Council House and continues to intimidate residents in a violet manner. The court order issued by Judge James A. Doerty, now on appeal, precludes mentioning the redacted directors’ and staff names. That order effectively gives Felippe Jacques immunity to continue to distribute hate mail and to act violently. Letter to Beresford

Further to my letter (PT-01-01-0516), administrators have again removed the flyer that relates to the residents’ association meeting this evening. They left the McDermott flyer in place. By this, they have again excluded legitimate resident material from the bulletin board and favored external political announcements.

This morning I interviewed a resident that met with Stephen M. last week. He told that person that he will censor postings anytime he wishes without question. If the directors have not realized yet that they have a despot on their hands then federal investigators will probably inform them clearly.

I feel that I have given the directors many opportunities to correct the inequities at Council House. Therefore, I will prepare the documents for investigation then publish the details during the next few weeks. They will include allegations of ten cases of physical and psychological abuse during the past six months. One person has died apparently from the alleged abuse and I fear for others. Evidently, the persecution by M. and his staff does not relate to race or religion. Instead, it stems from preying upon the weakest people when they will not submit to some obscure ideology.

The person that sent the perceived "death threat" to me has also sent the following language:

I have a taste for violence, and occasionally I like to inflict pain on certain kind [sic] of individuals. . . . I have always enjoyed beating the shit out of gays and assorted low lifers. . . . As for the first Amendment, shove it up you ass.

I abhor violence and hate speech, therefore, I will warn the apparent homosexual and his care-giver of this perceived threat to their persons. I will request them to remain calm and not to retaliate in kind but to use a democratic process to complain. The HUD mandated procedure for grievances does not exist at Council House. Consequently, I will continue to point people with grievances to the appropriate outside assistance and file the necessary reports with those agencies.

Judge James A. Doerty, Superior Court, State of Washington, issued two anti-harassment orders and contempt citations to censor this forum by prior restraint at the behest of Council House directors and their administrator. Mary Kay Becker, Washington Court of Appeals affirmed them. Washington Supreme Court reversed most of those decisions (30 Mar 06).

Using their financial power, the directors obtained SLAPP (strategic lawsuit against public participation) court orders and contempt citations using perjured testimony against the author of valid exposé. They then had him jailed in solitary confinement.

In this case, SLAPP consists of frivolous charges designed to bankrupt an opponent and create a prior restraint. The landlords have used this tactic on several occasions to try to cover up issues that affect all their tenants.

Doerty thwarted an appeal of his findings for more than five years by withholding court documents and other manipulation. The author/publisher claims judicial bias and arbitrary censorship that deny him his rights under the First Amendment to the US Constitution and Washington State Constitution. Doerty has challenged a principle journalism ethic - seek truth and report it - by denying a reporter’s First Amendment rights. Doerty then wrote biased decisions all without due process of law.

His findings enabled Council House directors to cover up crimes that they and their administrators allegedly committed. A Washington Supreme Court review has allowed the public to know the names of people involved in elder abuse. It will also give an ethical prosecutor an opportunity to consider felony charges of homicide by abuse against Council House directors and their staff. [Homicide by Abuse]

Homicide ranks as a class A felony punishable by a maximum sentence of life imprisonment in a state correctional institution or by a fine of fifty thousand dollars or both. Both the victim’s family and a Council House administrator benefitted financially by allegedly defrauding federal and state agencies prior to death of a resident. [Who Killed Jackie Nations?]

Doerty’s order precluded naming the people involved which forced redaction of copy pending review. Washington Supreme Court reversed the trial court decision which relieves restrictions on publishing details regarding resident deaths and other abuse.
